“Banks Legal” means Banks Legal Consultancy FZE (Banks Legal, we or us), formed pursuant to the regulations of the RAK Free Zone Authority with limited liability under licence number 6001706 and we have our registered office at Ras Al Khiamah Free Trade Zone, Ras Al Khaimah, United Arab Emirates. Banks Legal acts as a legal consultancy and offers certain services on the website banks.wpengine.com (the Site).

These terms and conditions of website use together with the Acceptable Use Policy, Privacy Policy and Cookie Policy as contained herein (together the Terms), set out the terms of use on which you make use of the Site, as well as the services and products contained and provided therein, whether as guest or registered user. Use of the Site includes accessing, browsing or registering to use the Site.

Banks Legal will have no responsibility for any errors in any documentation or Forms submitted to any relevant authorities and/or third parties except where those errors were made by Banks Legal.

Your Account and Password

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party and you are entirely responsible for maintaining the confidentiality of your password.

Banks Legal shall not be liable for any losses you incur as a result of a third party using your account or password, even if it used without your knowledge. You are responsible for, and may be held liable for any losses incurred by Banks Legal, our affiliates, directors, employees, consultants, agents and representatives due to a third party's use of your account or password.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time if, in our reasonable opinion, you have failed to comply with any of the provisions of these Terms.

If you know or suspect that anyone other than you knows your user identification code or password, or if you become aware of any unauthorized use of your account, you must promptly notify us at admin@bankslegal.com.

Site Use

We do not guarantee that the Site, or any content on it, will always be available or be uninterrupted. Access to the Site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Site without notice. We will not be liable to you if for any reason the Site is unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to the Site.

You are also responsible for ensuring that all persons who access the Site through your internet connection are aware of these Terms and other applicable terms and conditions and policies, and that they comply with them.

Banks Legal may suspend access to the Site, due to maintenance works, net security reasons or force majeure with no obligation to reimburse or compensate you for the period in which access was suspended.

Access to the Site is strictly controlled by Banks Legal and Banks Legal reserves the right to change, modify, substitute or suspend or remove without notice any information or service from time to time.

Minors under the age of 21 are prohibited to register as a User of this website and are not allowed to transact or use the website. By using the Site, or agreeing to these Terms, you warrant and represent that you are least 21 years of age.

You may only use this Site to make legitimate enquiries or avail of the Services for yourself or another person for whom you are legally authorised to act.

You shall not:

  • post, transmit or disseminate any information on or via this Site which is or may be harmful, obscene, defamatory or otherwise illegal, or may cause an infringement of the rights of any other;
  • make any other unauthorised, false or fraudulent Forms;
  • use any software, routine or device to interfere or attempt to interfere electronically or manually with the operation or functionality of the Site including, but not limited to, uploading or making available files containing corrupt data or viruses via whatever means;

  • take any action that imposes an unreasonable or disproportionately large load on this Site or related infrastructure.

Without prejudice to any of Banks Legal's other rights, Banks Legal reserves the right to deny access to this Site and/or deny use of the Services wherever and whenever Banks Legal believes (at Banks Legal's absolute discretion) that you are in breach of any of the Terms.

We accept payments online using Visa and MasterCard credit/debit card in United Arab Emirates Dirhams. However, if you make a payment for our products or services on our website from outside of the United Arab Emirates, or in a currency other than United Arab Emirates Dirhams, there may be an additional charge imposed for any currency conversion costs levied.

If “Credit Card Online” is selected as the payment method then the details on the customers ID should exactly match that of the credit card used to make the purchase.

If you make a payment for our products or services on our website, the details you are asked to submit will be provided directly to our payment provider via a secured connection.

The cardholder must retain a copy of transaction records and merchant policies and rules.

Delivery Policy

Any products purchased on the Site will be sent via email to the email address provided by the purchaser.

We will NOT deal or provide any services or products to any of OFAC sanctions countries in compliance with the law of the United Arab Emirates.

Refund Policy

Refunds will be done only through the Original Mode of Payment.

Links and Downloads

Banks Legal may provide hyperlinks or pointers to other websites maintained by third parties which Banks Legal thinks may be of interest to visitors of the Site.

Such other websites are not under the control of Banks Legal or maintained by Banks Legal and we have no control over and are not responsible for the content of such websites. Banks Legal provides these links for your convenience only but does not monitor or endorse the material on them. We are the owner or the licencee of all copyright and intellectual property rights in relation to the Site, the material on the Site, the Forms and the Services, and in the material published on them. The limitations and exclusions of liability set out in this Limitation of Liability section, and elsewhere in these Terms are subject to the above exclusion paragraph and govern all liabilities arising under these Terms or relating to the subject matter of these Terms, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty, except to the extent expressly provided otherwise in these Terms.

To the maximum extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Site, the use of our Site or any content on it, whether express or implied.

Banks Legal will not be liable to you in respect of any special, indirect or consequential loss or damage.

Banks Legal makes no warranty that the Site or the Services will meet your requirements, that any materials or documents offered or obtained from the Site will be accurate or reliable, or that the quality of the Services will meet your expectations.

We will not be liable to any visitor of the Site for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, our Site; or
  • use of or reliance on any content displayed on our Site.

If you are a business user, please note that in particular, we will not be liable for:

  • loss of or damage to profits, income, sales, business, revenue, or production;

In no event shall the total liability of Banks Legal to you for all damages, losses and costs and causes of action (including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty, except to the extent expressly provided otherwise in these terms and conditions) arising from the terms of your use of this Site exceed, in the aggregate, fifty percent of the fee amount of any Service purchased from the Site.

Please note that we only provide our Site for domestic and private use. You agree not to use our Site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any content on it, or on any website linked to it.

Viruses

We do not guarantee that the Site will be secure or free from bugs or viruses.

Governing Law and Dispute Resolution

If you use our Site from locations outside the UAE you are responsible for compliance with any applicable local laws.

These Terms, its subject matter and its formation, are governed by and construed in accordance with, English law.

In the event of you bringing any claim against us in relation to these Terms, you agree that the Courts of Dubai International Financial Centre shall have exclusive jurisdiction in relation to any such claim. In the event of us bringing a claim against you, you agree that the Courts of the Dubai International Financial Centre shall have non-exclusive jurisdiction in relation to any such claim.
